Law360, New York (July 30, 2012, 4:59 PM EDT) -- The Ninth Circuit said Monday that the U.S. Department of Health and Human Services was within its rights when it chose to refuse Medicare coverage for a device that treats osteoarthritis of the knee, echoing a previous ruling by the Fourth Circuit.
