Aceto Triumphs Over Bayer In Pesticide Trademark Fight

Law360, New York (July 31, 2012, 5:13 PM EDT) -- A New York federal judge on Monday handed Aceto Agricultural Chemicals Corp. a win in a trademark dispute with Bayer CropScience LP, finding that farmers were unlikely to confuse Aceto's "Profine 75" line of herbicide products with Bayer's "Proline" product.

U.S. District Judge Alison J. Nathan granted Aceto's bid for declaratory relief that its Profine 75 name used on pesticides did not infringe Bayer's trademarked Proline product, rejecting all of Bayer's trademark infringement counterclaims based on significant differences in packaging color and format that outweighed the...
