NJ Court Backs Toss Of NuvaRing Suit Against Organon

Law360, New York (August 1, 2012, 7:53 PM EDT) -- A New Jersey appellate court on Wednesday backed the dismissal of a product liability suit against pharmaceutical company Organon USA Inc. over the contraceptive NuvaRing because the plaintiff didn't file the action within a two-year statute of limitations.

Considering whether New Jersey's discovery rule could toll that limitations period, the appellate judges agreed that Virginia resident Stephanie Millian knew or should have known more than two years before she filed her complaint that she had the foundation for a claim against Organon.
