Judge Mulls Stay In Roche's Xeloda Patent Suit Against Teva

Law360, New York (August 2, 2012, 6:58 PM EDT) -- A New Jersey federal judge on Thursday said she was inclined to stay Hoffman-La Roche Inc.'s patent infringement action against Teva Pharmaceuticals USA Inc. over chemotherapy drug Xeloda based on the dismissal of an earlier case and its pending appeal.

During a hearing in Newark, U.S. District Judge Esther Salas, who oversaw the earlier case filed in 2009, said that case's dismissal with prejudice based on standing never was meant to be a ruling on the merits, but she saw little avenue for letting the present...
