FTC Drops Bid To Block Western Refining Merger

Law360 (October 3, 2007, 12:00 AM EDT) -- The Federal Trade Commission has voted to drop its challenge of the proposed $1.4 billion merger between Western Refining Inc. and Giant Industries Inc., despite its continuing belief that the merger is anti-competitive.

In a statement released Wednesday, the FTC's commissioners said they strongly disagreed with a district court's decision to deny their request for a preliminary injunction in the case. However, three of the five commissioners concluded that an administrative proceeding would require additional resources that would be better utilized for other competition matters....
