Destroyed Docs Get Mushroom Co. Sanctions In Antitrust MDL

Law360, New York (August 3, 2012, 2:54 PM EDT) -- A Pennsylvania federal judge sanctioned M.D. Basciani & Sons Inc. on Wednesday in multidistrict litigation alleging a conspiracy to hike mushroom prices, holding the mushroom seller liable for an affiliated distributor's destruction of documents sought by the plaintiffs.

U.S. Magistrate Judge Timothy R. Rice granted a motion from direct purchaser plaintiffs Giant Eagle Inc. and Publix Super Markets Inc. seeking sanctions for spoliation, which stemmed from a 2007 request for transactional data on mushroom sales and prices.
