Hurley Says Old Navy Flouted Surf Trunk Patent

Law360, New York (August 6, 2012, 3:50 PM EDT) -- Nike Inc. unit Hurley International hit Old Navy LLC with a patent infringement suit Thursday, accusing the retailer in California federal court of ripping off its design for boardshort swim trunks.

The surfing apparel company says Old Navy — a division of The Gap Inc. — has been selling trunks that directly copy the purportedly unique technology behind Hurley's Phantom boardshorts, which the surfing brand says is protected by two U.S. Patent and Trademark Office registrations.
