Capital One Says $250M Settlement Bars AG Credit Card Suits

Law360, New York (August 6, 2012, 1:32 PM EDT) -- Capital One on Friday urged a judge to bar attorneys general from Hawaii and Mississippi from pursuing consumer fraud lawsuits over its Payment Protection product, saying its 2010 class action settlement of $250 million bars future litigation over the credit card program.

Capital One says the April 12 suit filed by Hawaii Attorney General David Louie and June 28 suit filed by Mississippi Attorney General Jim Hood in their respective states’ courts seek to cover consumers already covered by the nationwide class settlement agreement. The bank...
