Settlements Don't Preclude Decertification Appeals: 7th Circ.

Law360, New York (August 6, 2012, 8:45 PM EDT) -- The Seventh Circuit ruled Monday that appeals of class decertification orders should be allowed even if proposed class representatives have entered into a settlement, denying a bid from DirectSat USA LLC to dismiss such an appeal lodged by workers alleging employment law violations.

A three-judge panel said that Aaron Espenscheid and two other DirectSat technicians could continue their challenge to a Wisconsin federal judge's ruling that decertified class status, despite their subsequent settlement of individual claims that DirectSat violated the Fair Labor Standards Act.
