5th Circ. Bolsters Excess Insurers' Late-Notice Claims

Law360, New York (August 7, 2012, 7:52 PM EDT) -- The Fifth Circuit ruled Thursday in a coverage dispute over a personal injury suit that excess carriers can be prejudiced when policyholders notify them of a suit only after an unfavorable jury verdict, a decision excess carriers could use in future suits to argue they're entitled to the same late-notice standards as primary insurers, experts say.
