Whirlpool Beats Maytag Retirees' ERISA Suit In 8th Circ.

Law360, New York (August 7, 2012, 6:30 PM EDT) -- Given no contractual language to the contrary, Whirlpool Corp. has the right to modify retiree benefits packages conferred on former employees of 2006 acquisition Maytag Corp. over the protests of the workers' union, the Eighth Circuit ruled Tuesday.

The appellate court affirmed an Iowa federal court's ruling that Whirlpool can make unilateral changes to Maytag retirees' health plans in spite of the United Automobile, Aerospace and Agricultural Implement Workers International Union's contention that these workers' benefits were vested pursuant to a 2004 collective bargaining agreement entered...
