Vague $5M Settlement Orders Not Appealable, 11th Circ. Says

Law360, New York (August 7, 2012, 7:53 PM EDT) -- An order enforcing a settlement that is not described as an injunction and lacks the specific terms of an injunction cannot be appealed, the Eleventh Circuit said Tuesday in a published ruling that upheld an oil contractor's $5 million bribery settlement.

The appeals panel said a district court must either state that it issuing an injunction or follow Rule 65(d) of the Federal Rules of Civil Procedure, which requires a detailed description of the actions being restrained or required. If an order enforcing a settlement accomplishes...
