Circuit Ruling Should Kill ERISA Suit: Diebold

Law360, New York (October 9, 2007, 12:00 AM EDT) -- Automatic teller manufacturer Diebold Inc. claims that a recent appellate court ruling which rejected “artificial inflation” of securities claims should compel a court to dismiss a purported class action lawsuit which accuses the company of mismanaging employee retirement benefits.
