J&J Hits Back At Red Cross' Motion To Dismiss

Law360, New York (October 9, 2007, 12:00 AM EDT) -- A trademark infringement lawsuit over the red cross symbol grew more caustic on Monday, with Johnson & Johnson accusing the American National Red Cross of using “unpersuasive merits arguments” to try and dismiss a portion of the case.

In court documents filed Monday with the U.S. District Court for the Southern District of New York, J&J said the Red Cross' partial motion to dismiss should be rejected in its entirety. The pharmaceutical company also asked for permission to re-plead if its complaint is in any way...
