Judge Certifies GNC Managers In Off-the-Clock Action

Law360, New York (August 16, 2012, 6:00 PM EDT) -- A Pennsylvania federal judge on Thursday granted conditional certification to a nationwide class of General Nutrition Centers Inc. store mangers who claim the health supplement retailer forced them to work off the clock.

U.S. District Judge Terrence F. McVerry said the managers had shown sufficient evidence to warrant first-stage collective certification on their claim that GNC violated the Fair Labor Standards Act by imposing hour-budgets on managers that encouraged them not to report hours worked.
