Law360, New York (August 17, 2012, 3:48 PM EDT) -- An Arkansas federal judge refused on Thursday to grant conditional collective action certification to a “breathtakingly broad” class of workers in an overtime case against Welspun Tubular LLC and Welspun Pipes Inc., ruling that the plaintiffs hadn't met the modest requirements for notice-stage certification.
U.S. District Judge D.P. Marshall Jr. noted that the burden of proof for winning conditional certification in a Fair Labor Standards Act case is light, but the judge said that the six named plaintiffs hadn't satisfied that lenient standard.
