Merck, Patients Fight Over Fosamax Discovery Tab

Law360, New York (October 10, 2007, 12:00 AM EDT) -- Merck and the patients who sued over its bone drug Fosamax are sparring over who should fund discovery requests in the multidistrict litigation.

In papers filed Tuesday in the U.S. District Court for the Southern District of New York, Merck proposed a deal in which the plaintiffs would reimburse it for all the copies it made of documents it had requested at a rate of $.05 per page, plus costs of production media.
