DC Circ. Blocks Trade Group Challenge To Ethanol-Gas Blend

Law360, New York (August 17, 2012, 4:23 PM EDT) -- The D.C. Circuit on Friday rejected a petition by a coalition of food, petroleum and engine manufacturing trade groups seeking to overturn the U.S. Environmental Protection Agency's approval of a controversial new 15 percent ethanol-gasoline blend, saying the groups lacked standing to bring the challenge.

In a 2-1 decision, the appeals court ruled that the trade groups had failed to establish that they have suffered any actual harm from the EPA's decision to issue a waiver allowing the so-called E15 fuel into the market. The groups...
