Harbor Freight Chalks Win As Managers Denied Cert In OT Suit

Law360, Los Angeles (August 20, 2012, 4:40 PM EDT) -- A Kansas federal judge Friday decertified a class of store managers suing retail chain Harbor Freight Tools USA Inc. for allegedly misclassifying them to avoid paying overtime, saying differences in individual job responsibilities would require numerous mini-trials in the Fair Labor Standards Act suit.

Friday’s ruling leaves five store managers who brought the FLSA collective action against the tool retail chain to pursue their overtime claims alone, without 31 additional managers who successfully opted into the suit after a class was conditionally certified in August 2010....
