Reynolds Asks 2nd Circ. To Quash $24M Tobacco Verdict

Law360, New York (August 21, 2012, 7:01 PM EDT) -- R.J. Reynolds Tobacco Co. on Monday asked the Second Circuit to reverse a $24 million judgment awarded to a woman who developed throat cancer after years of smoking Salem cigarettes, saying the district court had blocked Reynolds from presenting potential alternative causes of her illness.

Reynolds says the district court effectively reversed the burden of proof when it didn't allow the consideration of expert testimony that factors other than Salem cigarettes — including human papillomavirus and gastroesophageal reflux disease — may have caused Barbara Izzarelli’s larynx...
