NY Court Flips Privilege Ruling In $50M Hedge Fund Pay Suit

Law360, New York (August 21, 2012, 7:15 PM EDT) -- A report detailing files held by one of two former Touradji Capital Management LP portfolio managers who filed a $50 million compensation suit against the New York City hedge fund is not privileged information, a state appeals court ruled Tuesday, reversing the trial court.

A unanimous panel in the First Department of the New York State Supreme Court Appellate Division reversed a November 2011 ruling by Manhattan commercial court Judge Richard B. Lowe III that said the entire report related to Robert A. Vollero Jr.'s computer files was privileged and couldn't be viewed by attorneys for Touradji Capital.
