Evanston Wins 5th Circ. Coverage Row In Organ Selling Case

Law360, New York (August 24, 2012, 6:44 PM EDT) -- The Fifth Circuit said Friday that Evanston Insurance Co. didn't have to cover Legacy of Life Inc. in an underlying lawsuit accusing the organ donation company of making money from the sale of body parts, despite its nonprofit status.

The appeals panel said it was able to make the ruling following the Texas Supreme Court’s decision last month that losing the use of a deceased person's tissues, organs, bones and body parts doesn't count as property damage or personal injury for the person's estate or next...
