NJ Court Sends Retired Cops' Benefits Suit To Arbitration

Law360, New York (August 28, 2012, 7:07 PM EDT) -- A New Jersey appeals court on Tuesday nixed a town's bid to stop its police unions from challenging changes to health benefits for retired officers, ruling that the state Fraternal Order of Police can take its grievance to the Public Employment Relations Commission for binding arbitration.

The decision shuts down Voorhees Township's attempt to overturn the PERC's ruling that the town can't bar arbitration of the unions' grievance, which stems from a reduction in prescription reimbursements for retired officers.
