Acorda Sues Apotex Over Proposed Generic Zanaflex

Law360, New York (October 12, 2007, 12:00 AM EDT) -- Acorda Therapeutics Inc. has sued generic drug maker Apotex Inc., saying that Apotex planned to infringe an Acorda patent relating to its muscle-relaxing drug Zanaflex by asking the U.S. Food and Drug Administration to approve a generic version of the drug.

Acorda's so-called '557 patent claims a method for preparing and administrating the active chemical in Zanaflex in order to minimize drowsiness, a common side effect of the drug.

The patent describes instant-release tablets in various concentrations, and various schemes to coordinate doses with patients' meals....
