Judge Broadens Class In Apria FLSA Class Action

Law360, Philadelphia (August 30, 2012, 3:51 PM EDT) -- A Pennsylvania federal judge on Wednesday broadened a conditionally certified class in a lawsuit over off-the-clock work against Apria Healthcare Inc., allowing workers with six more different job titles to be part of the class.

U.S. District Judge Jan Dubois determined the six additional positions were substantially similar to that of plaintiff Connie Titchenell, a customer service specialist who worked for the home health care provider until 2010. The judge issued conditional certification to a class of customer service specialists in November 2011.
