Wyeth Loses Bid To Toss 2 Fen-Phen Suits

Law360, New York (August 31, 2012, 3:23 PM EDT) -- A Pennsylvania federal judge on Thursday denied Wyeth LLC’s attempt to toss two remaining suits in multidistrict litigation alleging its fen-phen diet drugs caused fatal lung disease, saying a nationwide settlement reached more than a decade ago does not bar the complaints from going to trial.

Wyeth, a unit of pharmaceutical giant Pfizer Inc., sought to enjoin plaintiffs Jamie D. Cheek and Valerie Farmer from continuing with their lawsuits over the Pondimin and Redux diet drugs in South Carolina federal court and Pennsylvania state court, respectively....
