Ariz. Win Won't End Fight Over Secret Ballot Law For Unions

Law360, New York (September 6, 2012, 8:46 PM EDT) -- Arizona defeated on Wednesday the National Labor Relations Board's challenge to a state constitutional amendment guaranteeing secret ballot elections for union representation, but experts say the fight over the law is likely far from over.

U.S. District Judge Frederick J. Martone granted the state summary judgment in the NLRB's lawsuit claiming the voter-approved amendment was preempted by federal labor law, ruling it inappropriate to assume the law would be applied in a way that conflicted with the National Labor Relations Act.
