Fed. Circ. Affirms K-Tec's $24M Win In Blender Patent Row

Law360, New York (September 6, 2012, 3:14 PM EDT) -- The Federal Circuit on Thursday rejected Vita-Mix Corp.'s appeal of $24 million in damages that a Utah federal court ordered it to pay rival K-Tec Inc. for selling blenders that infringed two of K-Tec's patents.

In a precedential opinion, the appeals panel affirmed the lower court’s ruling that there was substantial evidence supporting the validity of K-Tec’s patents, that Vita-Mix willfully infringed those patents, and that K-Tec was entitled to reasonable royalty and lost profits in damages following a 2010 jury trial that K-Tec won....
