WellPoint Price-Fixing MDL Survives Dismissal Bids

Law360, New York (September 7, 2012, 6:18 PM EDT) -- A California federal judge on Thursday trimmed long-running multidistrict litigation accusing WellPoint Inc., UnitedHealth Group Inc. and others of conspiring to underpay health care providers, dismissing Sherman Act and other claims after finding certain plaintiffs lacked standing.

In a 52-page decision, U.S. District Judge Philip S. Gutierrez nixed many allegations in the sprawling case, including Employee Retirement Income Security Act and Racketeer Influenced and Corrupt Organizations Act claims, but he refused to dismiss the plaintiffs' complaints altogether.
