Burlington Seeks Contempt Reversal In Fendi Feud

Law360 (October 17, 2007, 12:00 AM EDT) -- Burlington Coat Factory Warehouse Corp. and Cohoes Fashions Inc. have asked a New York federal judge to reconsider an order that found the discount retailers violated an injunction by selling Fendi SA-branded perfume.

The discount retailers filed a motion for reconsideration on Monday in the U.S. District Court for the Southern District of New York. It claims that Burlington implicitly bought Fendi perfume from the Italian designer and that Cohoes never purchased or sold Fendi products after being reminded of a consent injunction.
