Eye Med Distributor Lobs $100M Suit Over Supply Contract

Law360, New York (September 12, 2012, 8:48 PM EDT) -- Eye medicine distributor Fera Pharmaceuticals LLC lodged trade secrets, unfair competition and breach of contract claims against Akorn Inc. in New York state court Wednesday, seeking at least $100 million in damages over allegations that Akorn broke the terms of a supply deal.

Fera, which markets and distributes anti-infective eye medicines, alleges that Akorn agreed in 2009 to manufacture and supply products marketed by Fera — including bacitracin and erythromycin eye ointments — but did not abide by the terms of the contract, the suit said....
