Evanston Wants Off Hook For Staffing Co.'s Junk Fax Row

Law360, Chicago (September 14, 2012, 4:03 PM EDT) -- Evanston Insurance Co. sued health care staffing firm Harris Medical Associates LLC in Missouri federal court Thursday, asking a court to declare that it does not have to defend or indemnify Harris in an underlying putative class action accusing it of sending unsolicited fax advertisements.

The insurer is fighting coverage for the class action petition St. Louis Heart Center Inc. filed in Missouri state court July 12 accusing Suwanee, Ga.-based Harris of violating the Telephone Consumer Protection Act and state consumer fraud and deceptive business practices...
