Whole Foods, Forever Cheese Sued Over Listeria Poisoning

Law360, New York (September 18, 2012, 4:50 PM EDT) -- A Pennsylvania couple hit Whole Foods Market Inc. and Forever Cheese Inc. on Monday with a lawsuit alleging the husband contracted Listeria monocytogenes from ricotta cheese that was distributed and sold by the companies.

The complaint alleges John McKissick suffered “profound nervous system and cognitive dysfunction, including ventilator-dependent respiratory failure,” after he ate cheeses purchased at a Whole Foods in Pittsburgh. It seeks monetary damages for him and his wife, Patricia.
