DSE Says Lost Evidence Nixes Defective Grenade FCA Suit

Law360, New York (September 18, 2012, 2:25 PM EDT) -- Defense contractor DSE Inc. asked a Florida federal judge Tuesday to toss a former employee's False Claims Act suit alleging the company provided defective grenades to the U.S. military, saying the loss of key evidence has irreparably marred the case. 

DSE said relator John D. King recently revealed that key video diaries which he said would hurt his own case had been destroyed in an alleged burglary, the details of which are hazy. The diaries' destruction is the last straw in King's delays and discovery abuses...
