Enviro Sues NY To Access Fracking Plan Messages

Law360, New York (September 19, 2012, 2:17 PM EDT) -- The Environmental Working Group brought suit Monday in New York state court against Gov. Andrew Cuomo’s administration in order to gain public records that the nonprofit claims will detail the energy industry’s attempts to influence state regulation of high-volume hydraulic fracturing.

EWG alleges Cuomo’s administration has violated the state’s Freedom of Information Law by hampering its attempts to access documents that could shed light on how the administration drafted its controversial plan allowing high-volume fracking and horizontal drilling for shale gas in rural upstate New York....
