Chantix Plaintiffs Can Gun For Punitive Damages In Bellwether

Law360, New York (September 19, 2012, 7:33 PM EDT) -- An Alabama federal judge on Tuesday allowed plaintiffs to add a punitive damages claim to one of the bellwether cases in multidistrict litigation alleging Pfizer Inc. should have known its smoking cessation drug Chantix was linked to depression and suicidal behavior.

U.S. District Judge Inge Prytz Johnson's ruling opens the door for Minnesota plaintiff Judy Ann Whitely to claim punitive damages in the first of a handful of test cases to go to trial next month, from the more than 2,000 suits in the Chantix MDL....
