Dollar Tree Managers Lose Class Cert. In OT Suit

Law360, New York (September 19, 2012, 5:39 PM EDT) -- An Alabama federal judge on Wednesday decertified a class of Dollar Tree Stores Inc. managers who claim the chain misclassified them to avoid overtime, ruling that their job duties were too diverse for collective action.

U.S. District Judge L. Scott Coogler said it would require extensive individual investigation to determine whether Dollar Tree was legally allowed to label each store manager as an executive — a type of position that's exempt from overtime under the Fair Labor Standards Act.
