Insurers Want Off Hook For Palm Cellphone Radiation Suit

Law360, New York (September 21, 2012, 12:53 PM EDT) -- Three Illinois insurers on Thursday asked a Cook County state court to declare it is not obligated to defend or indemnify Palm Inc. in an underlying suit alleging Palm’s cellphones exposed consumers to radiation, saying the allegations aren’t covered in Palm’s policies.

Valley Forge Insurance Co., National Fire Insurance Co. of Hartford and Continental Casualty Co. filed suit against Palm and its parent company Hewlett-Packard Co., pointing to exclusions in Palm’s primary and excess insurance policies stipulating that injuries or damages from electromagnetic or ionizing radiation...
