2nd Circ. Mulls Suit Against Coke Over Guatemalan Violence

Law360, New York (September 24, 2012, 7:58 PM EDT) -- Guatemalans who claim a Coca-Cola Co. bottler in their home country intimidated union leaders with a campaign of violence on Monday asked the Second Circuit to revive a U.S. lawsuit against the company, saying they have been denied a forum.

A federal judge's decision to force the plaintiffs to pursue their suit in Guatemala rather than the U.S. has left them without a place to bring the action, attorney Christian Levesque of Conrad & Scherer LLP told a Second Circuit panel at oral arguments.
