Medtronic Destroyed Defective Device: Suit

Law360 (October 22, 2007, 12:00 AM EDT) -- A couple from Texas has lodged a product liability case against Medtronic Inc. that includes allegations of spoliation of evidence and conversion/civil theft, claiming that the medical device maker destroyed a dorsal column stimulator that was surgically removed from plaintiff David Kuhn after it malfunctioned.

Elisha and David Kuhn filed an eight-count suit against Medtronic in the U.S. District Court for the Eastern District of Texas on Friday, seeking unspecified damages.
