Agencies Get Del. River Basin Fracking Suits Tossed

Law360, New York (September 24, 2012, 6:14 PM EDT) -- A New York federal judge on Monday tossed three suits alleging federal agencies failed to conduct an environmental review of natural gas development of the Delaware River Basin before moving ahead with drafting new regulations opening the area up to hydraulic fracturing.

U.S. District Judge Nicholas G. Garaufis said the three suits, which were consolidated for pretrial purposes only, brought by the state of New York, Damascus Citizens for Sustainability Inc., the National Parks Conservation Association and other environmental groups lacked standing and were not ripe...
