TransCanada Can Gain More Texas Land For Keystone Project

Law360, New York (September 25, 2012, 6:47 PM EDT) -- A Texas state judge on Monday all but gave TransCanada Corp. the go-ahead to seize more land via eminent domain for its Keystone XL pipeline project, pending the court's approval of a bond later this week.

Jefferson County Judge Tom Rugg Sr. ruled that the company is indeed a “common carrier,” and therefore allowed to condemn the land, rejecting Texas Land Rice Partners Ltd.'s claims that its common carrier status must have been determined before the petition for possession was filed.
