U.K. Judge Denies Request For Exemplary Damages

Law360, New York (October 23, 2007, 12:00 AM EDT) -- The High Court of Justice in the United Kingdom has ruled that punitive damages are not available when a member of an alleged cartel has already been fined by the European Commission or the U.K. Office of Fair Trading.

In a decision Friday, Mr. Justice Lewison said that a company cannot be fined or punished more than once.

In the case, a number of drug makers including, Sanofi-Aventis, F. Hoffmann-La Roche AG, were accused of participating in a conspiracy to increase the prices of vitamins. The...
