New Calif. Law Frees Road Safety Projects From Enviro Review

Law360, San Diego (September 26, 2012, 4:33 PM EDT) -- A measure allowing certain roadway projects to bypass review under California’s environmental law was signed by Gov. Jerry Brown on Tuesday.

The governor approved A.B. 890, which exempts from the California Environmental Quality Act roadway safety updates as long as the project is on an existing road and does not cross a waterway or worsen traffic.

Only cities and counties with a population under 100,000 will be able to claim the exemption, and the law excludes projects on state roadways as well as plans that harm...
