Novartis Wants Pesticide Suit Nixed For Discovery Failing

Law360, New York (September 27, 2012, 3:47 PM EDT) -- Novartis Crop Protection Inc. argued Wednesday that an alleged failure to timely produce evidence comprising more than 800 photographs should sink a lawsuit brought by New Jersey blueberry farmers accusing the company of manufacturing a pesticide that damaged their crops.

Novartis contends in a dismissal motion that, less than a week before a trial in the case is scheduled to begin, the farmers produced the photographs by one of their witnesses, William Sciarappa, as demonstrative exhibits for the Oct. 1 proceeding. The company said the photographs...
