Boston Police Drug Test Passes Discrimination Challenge

Law360, New York (October 3, 2012, 3:32 PM EDT) -- A Massachusetts federal judge on Monday tossed an employment suit brought by black police officers who accused the Boston police department of using discriminatory drug-screening tests, ruling that the tests impacted blacks and whites almost equally.

U.S. District Judge George O’Toole granted the city of Boston summary judgment after finding that black passage rates — which trailed white passage rates by 1 to 3 percentage points — failed to prove that the police department engaged in a campaign to fire black officers.
