Insurers See Ways Around Calif.'s Landmark Stacking Ruling

Law360, New York (October 18, 2012, 10:07 PM EDT) -- By relying heavily on now-outdated policy language, the California Supreme Court left some room for insurers to combat a potentially devastating ruling that allows policyholders to stack policies to score maximum coverage for long-tail claims, attorneys say.

When the state high court sided with California in a long-running pollution coverage battle with Continental Insurance Co. and five other excess carriers in August, it handed a major win to insureds facing claims of property damage or injury spanning across multiple policy periods.
