NY Judge Cans Binghamton's Ban On Gas Drilling, Fracking

Law360, Washington (October 3, 2012, 6:35 PM EDT) -- A New York state judge on Tuesday tossed out the city of Binghamton's temporary ban on natural gas drilling activities, including hydraulic fracturing, saying the city failed to show how such permits or activities would harm the community.

According to state Supreme Court Justice Ferris D. Lebous' order, Binghamton has the right to to ban gas drilling, exploration and storage in the municipality, but it has to follow mandatory referral requirements or show that there is a dire necessity or crisis for the immediate moratorium, saying...
