Judge Won't Enforce 2005 Settlement, Stop Cigna Class Suit

Law360, New York (October 3, 2012, 6:18 PM EDT) -- A Pennsylvania federal judge on Tuesday refused to enforce a 2005 class settlement between Cigna Corp. and employees that the health insurer claims bars another class action in Illinois federal court brought by some of the same plaintiffs raising similar allegations of retirement plan mismanagement.

U.S. District Judge Paul S. Diamond denied Cigna's motion to enforce the settlement, saying the Pennsylvania court does not have personal jurisdiction over the vast majority of the 34,000 settling plaintiffs and effectively allowing the Illinois case to continue.
