ITC Curbs Imports Of Fortinet Antivirus Software

Law360, New York (August 10, 2005, 12:00 AM EDT) -- Severe import restrictions were placed on California-based antivirus company Fortinet, Inc. by the U.S. International Trade Commission, jeopardizing U.S. sales of the company’s software.

Tokyo-based Trend Micro Inc. asserted the patent against Fortinet at the ITC in May 2004, claiming infringement of its antivirus technology for computer network servers.

The ITC’s equitable ruling follows the final initial decision in favor of the complainant, handed down in May by an ITC administrative law judge. The ITC Commission declined to review the judge’s final decision in June, instead...
